1. This web site and associated SMS services are operated and controlled by Cambridgeshire County Council.

2. Use of this web site and associated SMS services is governed by these Terms. If a user does not accept these Terms they should exit the web site immediately.

3. Cambridgeshire County Council may at any time revise these Terms. It is up to the user to regularly review the Terms in case there are any changes. Continued use of the web site and SMS services after a change has been made is to be treated as acceptance of that change by the user.

4. Disclaimer

While Cambridgeshire County Council tries hard to ensure that the web site and SMS services are functioning correctly and are as accurate as possible, this will not always be achievable and therefore the following disclaimer applies.

(a) The Website, SMS service and Content is provided “AS IS” and on an “AS AVAILABLE” basis and neither Cambridgeshire County Council nor its suppliers of third party data guarantee the accuracy, timeliness, completeness, performance or fitness for a particular purpose of the Website or any Content whatsoever. In particular, Cambridgeshire County Council does not guarantee or represent that the content and/or facilities available or accessible via the web site and SMS services will always be accurate, complete or current or that access to the web site and SMS services will be uninterrupted.

(b) Cambridgeshire County Council expressly disclaims all liability for any direct, indirect or consequential loss or damage occasioned from the use or inability to use the web site and/or SMS services, whether directly or indirectly resulting from inaccuracies, defects, viruses, errors - whether typographical or otherwise, omissions, out of date information or otherwise.

(c) Accessing the web site and the downloading of material from it is done entirely at the user's own risk. The user, and not Cambridgeshire County Council, will be entirely responsible for any resulting damage to software or computer systems and/or any resulting loss of data even if Cambridgeshire County Council has been advised of the possibility of such damage.

6. Jurisdiction

These Terms will be governed and construed in accordance with the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction over disputes between a user and Cambridgeshire County Council arising out of the access or use of this web site and associated SMS services. Omission by Cambridgeshire County Council to exercise any right under these Terms will not constitute a waiver of such right unless expressly stated by Cambridgeshire County Council in writing.

Unless expressly stated the copyright and other intellectual property rights (such as, design rights, trademarks, patents etc.) in any material provided on this web site remains the property of Cambridgeshire County Council (or as the case may be another rightful owner). Cambridgeshire County Council owned material on the web site including text and images, may not be printed, copied, reproduced, republished, downloaded, posted, displayed, modified, re-used, broadcast or transmitted in any way, except for the user's own personal non-commercial use.
